1. Personal Data Protection

If you are my customer, newsletter subscriber, or website visitor, you entrust me with your personal data. I am responsible for their protection and security. Please familiarize yourself with the personal data protection, principles, and rights you have in connection with GDPR: Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the “Regulation”).

2. Who is the Data Controller?

I am Mgr. Marika Mikušová (permanent residence: Dolní Sklenov 14, Hukvaldy, 739 46, Czech Republic). My company ID is 09742379, and I operate the website www.denikletusky.cz.

I process your personal data as the data controller, meaning I determine how your personal data will be processed, for what purposes, for how long, and I select any additional processors who will assist me in processing. I declare that, as the controller of your personal data, I fulfill all legal obligations required by applicable law, particularly the Personal Data Protection Act and GDPR. I will therefore process your personal data only on the basis of a valid legal reason, primarily legitimate interest, contract performance, legal obligation, or given consent. In accordance with Article 13 GDPR, I provide this information before commencing personal data processing. I will enable and support you in exercising your rights under the Personal Data Protection Act and GDPR.

4. Scope of Personal Data and Purposes of Processing

I process your personal data to varying extents depending on the services you use or the purpose for which the data is processed. I process personal data that you provide to me voluntarily for the following purposes:

4.1. Providing Services, Contract Performance
I process the following personal data depending on the type of product or service provided: first name, last name, academic titles, permanent address, temporary address, email address, date of birth.

4.2. Accounting
If you are a customer, I necessarily require your personal data (billing information) to comply with legal obligations for issuing and recording tax documents.

4.3. Shipping
If you are a customer, I necessarily require your personal data (billing information) for the delivery of physical products via a shipping service.

4.4. Marketing
I use your personal data (email and name), gender, what you click on in emails, and when you most frequently open them, for the purpose of direct marketing — sending information about special discounts, free shipping opportunities, and other advantageous offers legally classified as commercial communications.

  • If you are my customer, I process this based on legitimate interest, as I reasonably assume that you are interested in my news and information, for a period of 7 years from your last order.

  • If you are not my customer, I send information about discounts, free shipping, and other special offers only if you wish to receive it and provide your consent, for a period of 7 years from the consent date.

In both cases, you can revoke your consent at any time using the unsubscribe link in each email sent.

4.5. Advanced Marketing Based on Consent
Only with your consent may I send inspiring offers from third parties or use your email address for remarketing and targeted advertising on platforms such as Facebook, for a period of 7 years from the date of consent. You may revoke this consent at any time via my contact details.

5. Cookies

When you browse my websites, I record your IP address, how long you stay on the page, and the page from which you arrived. I use cookies to measure website traffic and customize the display of web pages, which I consider a legitimate interest as the data controller, as I believe this allows me to offer you even better services. Cookies used for advertising purposes will only be processed based on your consent. My websites can also be browsed in a mode that does not allow the collection of personal data. You can disable the use of cookies on your computer.

6. Security and Protection of Personal Data

I protect personal data to the maximum possible extent using modern technologies corresponding to the current level of technical development. I have adopted and maintain technical and organizational measures to prevent misuse, damage, or destruction of your personal data, including: secure servers as data storage, secure email communication, advanced encryption on computers, encrypted data on mobile phones if used for communication with you, and all physical documents (e.g., accounting records, personal study documents) are stored in safes or locked premises.

7. Sharing Personal Data with Third Parties

Some of my employees and collaborators have access to your personal data. To ensure specific processing operations that I cannot perform on my own, I use the services and applications of data processors who can protect the data even better than I can, or who specialize in the given processing. Examples include the following platforms: SmartSelling a.s. as the provider of the SmartEmailing solution, FAPI Business s.r.o. as the operator of the FAPI accounting system, Simpleshop s.r.o., Facebook Ireland Ltd., Google Ireland Ltd., Microsoft, web hosting providers, accounting firms, graphic design companies (e.g., for certificate production), marketing specialists, instructors, consultants, and coaches providing training and consultations. Only the strictly necessary personal data is provided to all these third parties. It is possible that in the future I may decide to use additional applications or processors to facilitate and improve data processing.

8. Transfer of Data Outside the European Union

All processing of personal data will be carried out within the territory of the EU.

9. Your Rights Regarding Personal Data Protection

In connection with the protection of personal data, you have several rights. If you wish to exercise any of these rights, please contact me at: marika@denikletusky.cz.

  • Right to Information – fulfilled by this privacy policy page.

  • Right of Access – you may request information about what personal data I process and why. I will provide it within 30 days.

  • Right to Rectification – if your personal data changes or is inaccurate/incomplete, you can request correction or supplementation.

  • Right to Restrict Processing – you may exercise this right if you believe your data is inaccurate, unlawfully processed, or if you have objected to processing. Restriction may concern the scope of data or processing purposes (e.g., unsubscribing from newsletters limits processing for marketing purposes).

  • Right to Data Portability – you may request your personal data in a machine-readable format for transfer to another controller. This will be processed within 60 days.

  • Right to Erasure („Right to be Forgotten“) – you may request deletion of all your personal data from my systems and those of all processors and backups. I will do so within 60 days, except where legal obligations (e.g., tax record-keeping) require retention. You will be notified of completion by email.

  • Right to Lodge a Complaint – if you believe your data is processed unlawfully, you may file a complaint with the Office for Personal Data Protection. I would appreciate the opportunity to address your concerns first.

  • Unsubscribing from Marketing Communications – if you are my customer, I send you emails based on legitimate interest. If you are not, I send them only with your consent. You can unsubscribe anytime via the link in each email.

10. Confidentiality

I assure you that my employees and collaborators who process your personal data are bound by confidentiality obligations regarding personal data and security measures, the disclosure of which could compromise the protection of your data. This confidentiality obligation continues even after the termination of contractual relationships with me. Without your consent, your personal data will not be disclosed to any third party.

These principles of personal data processing and protection are valid from 1 October 2021.
